You grant United ELD a worldwide, royalty-free license to host, display, and use the User Content for Site operation and improvement. 8) Linking To Our Site

You may link to publicly accessible pages if the link:

  • Is fair and legal and does not damage our reputation;
  • Does not imply any sponsorship or endorsement;

We may request removal of any link at our discretion. Use of our logo for linking requires written authorization.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNITED ELD SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED US $100.

15) Indemnification

You agree to defend, indemnify, and hold harmless United ELD and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your: (a) use of the Site; (b) violation of these Terms; or (c) infringement or misappropriation of third-party rights.

18) Governing Law & Venue

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. The exclusive venue for disputes arising out of the Site is the state or federal courts located in Dallas County, Texas. You consent to personal jurisdiction in those courts.

We may update these Terms from time to time. The “Last Updated” date shows the most recent change. By continuing to use the Site after updates become effective, you accept the revised Terms.

20) General

  • Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver. Our failure to enforce a right is not a waiver of that right.
  • Entire Agreement. These Terms constitute the entire agreement regarding Site use and supersede prior or contemporaneous communications about the Site.
